Surrender a development consent

You may seek to surrender your development consent in accordance with Section 4.17 or 4.63 of the Environmental Planning and Assessment Act 1979.

Surrendering the consent means that the development can no longer proceed.

Any works which have been undertaken must be to the satisfaction of Council and no further works can take place.

Step 1.Important information you need to know

In order to surrender a development consent, you must ensure the following:

  • The development application was determined by Council
  • Only person/s who have the benefit of the consent are permitted to request to surrender consent.

Step 2.Refunds

No development fees will be refunded because the development application has already been determined.

If works commenced and Council was appointed as the certifying authority, you may be eligible for part refund of fees associated with the Construction Certificate.

Any refunds can only be returned to the original payee of the fees.

Step 3.Submit the request

Use the online form to submit a surrender request.

All landowners must sign the form or upload a separate attachment stating they consent to the surrender request.
