Changes to development controls for land at North Belongil Beach

Council received a request to amend Chapter E5 Certain locations in Byron Bay and Ewingsdale, of the Byron Development Control Plan (DCP) 2014.

The request refers to land north-west of Elements of Byron resort at Belongil. This land is also referred to as the North Byron Beach site.

Consultation closed on 23 February 2024. We thank you for your feedback. 

A submissions report is scheduled for 18 April 2024 Council meeting. The agenda for the meeting will be available on Council's minutes and agendas webpage from 9 April 2024.

About the changes

The land was rezoned in 2022 to C4 Environmental Living to enable a future residential subdivision.

The current DCP 2014 Chapter E5 does not contain requirements for residential development for this area. A new ‘Precinct 3’ Environmental Living proposes new controls for future dwellings.

A map of the location of the site and changes to Chapter E5, can be found in Section E5.7. New changes are shown in red text. Deletions are shown in red text with strikethrough.

Key changes include:

  • controls for design and sustainability of future dwellings to respond to the environmentally sensitive site
  • a control to prohibit the keeping of cats and dogs within the area
  • a control to limit the building footprint for each dwelling.
