Planning controls for The Farm, Ewingsdale

This planning proposal intends to amend the Byron Local Environmental Plan (LEP) 2014 to approve existing unauthorised land uses at The Farm, Ewingsdale. 

To support the planning proposal, Chapter E5 of Byron Development Control Plan 2014 (DCP) is being amended.

A new section relating to The Farm will be added setting out detailed planning controls for the nominated uses. This is to:

  • address issues of scale and potential impact
  • ensure any approved uses have and maintain an association with primary production.


  • Address: Corner Ewingsdale Road and Woodford Lane, Byron Bay.
  • Lot and DP: Lot 1 DP780234 and Lot 5 DP848222
  • Objective: To introduce a new local clause into the Byron LEP 2014 to allow a range of land uses that support farming activities. 
  • Status: DCP changes adopted and planning proposal progressing to finalisation.

Purpose of the Planning Proposal

  • The proposed provisions will identify a ‘Rural Activity Precinct’ and a ‘Farming Precinct’.
  • Existing commercial outlets for farming products grown on site will be allowed.
  • Opportunities such as farm field days and exhibitions for the community to learn about and appreciate farming, would also be allowed.
  • The Planning Proposal deals only with existing uses. It will not authorise new development.
  • The amendment to the LEP will not alter the existing RU1 (Primary Production) zoning of the land.

Where are we now?

Feedback on the proposal closed on 31 May 2021. A submissions report was considered by Council at 5 August meeting where it was resolved to:

  • forward the planning proposal to Department of Planning, Industry and Environment for finalisation
  • adopt the amended Byron DCP Chapter E5, to become effective on finalisation of the LEP amendment.  Finalisation is expected by mid 2022.
