A request to amend a Local Environmental Plan (LEP) (ie land zoning or other LEP provisions) is known as a planning proposal. A planning proposal is a document that explains the intended effect of, and justification, for the proposed change.

Rezoning of land at 268 Ewingsdale Rd Byron Bay (ex Sunnybrand Site)

The objective of this Planning Proposal(PDF, 1MB) is to rezone land located at 268 Ewingsdale Road, on the western edge of Byron Bay, described as part Lot 181 in DP 755695. It also affects a Crown Land drainage reserve that traverses the site and is described as part Lot 7022 DP 1113424.

The proposal will provide for additional industrial development and will also modify related Byron LEP 2014 planning controls to match the proposed industrial use of the land.

Following the issue of a Gateway Determination from the Department of Planning and Environment, the proponent of the Planning Proposal has submitted detailed site studies.  Council officers have now reviewed the studies and expect to report to the February 2019 Council meeting on the recommended next steps.  To confirm the date that this matter will be reported, please refer to our Council meeting agendas 

‘Housekeeping’ amendments

Housekeeping amendments are undertaken periodically to ensure that Council’s principle planning instrument is current and correct. 

  • Minor amendments - The objective of this planning proposal is to rectify minor errors and anomalies affecting Byron LEP 2014.  The planning proposal is currently being drafted and is expected to be submitted to the Department of Planning early 2019 for a Gateway Determination.
  • Policy amendments - The objective of this planning proposal is to introduce minor policy-related amendments to Byron LEP 2014. The planning proposal is currently being drafted, and a report is expected to be submitted to Council early 2019 recommending that the planning proposal be submitted to the Department of Planning for a Gateway Determination.
