Food Businesses

All permanent, temporary and mobile food businesses must apply for approval from Council to operate.

There are also food safety standards and practices that you need to follow. 

Registering your food premises with Council

Register your fixed food premises with Council by completing the online form. 

Food business registration form

There is no fee to register a permanent food business.

If a business owner changes, a new food business registration is required.

Inspections

Our Environmental Health Officers carry out inspections of food business at least on an annual basis.

Footpath Dining

If the premises has a current footpath dining license, the new business operator will need to apply for a new license.

Liquid Trade Waste

Any food business that lets waste water into a Council sewer must apply for liquid trade waste approval from us.

Notification of food premises

Food businesses may also be required to notify the NSW Food Authority.

Temporary Food Premises

To operate a temporary food premise, such as a food stall or market stall, you need to get the necessary approvals and be registered with Council.

A temporary food premises must operate from a gazebo type structure .  If you are using a vehicle you must register as a Mobile food vending vehicle or premises.

To register a temporary food business with Council, complete the registration form below and pay the relevant fees.

This form can also be used to renew a current license. 

The following documents are required to be uploaded, depending on your application:

  1. Floor layout plan (required for all applications)
  2. Registration with the Australian Charities and Not for Profits Commission (for Charities only)
  3. Food Safety Supervisor (FSS) Certificate (for non-low risk businesses)

To get approval, you must demonstrate that the food stall and operators will meet the relevant food safety requirements and standards.

You must receive written approval from Council before installing or operating a food stall. Our Environmental Health Officers may carry out an inspection of the food stall during operation, to ensure that the requirements are being met.

Applications for a temporary food premises are required to demonstrate compliance with:

  • Food Act 2003
  • Food Regulation 2010
  • Australian New Zealand Food Safety Standards 2001
  • other relevant standards.

Mobile Food Vending Vehicles or Premises

To operate a mobile food vending vehicle or premises in the Byron Shire, you need to get approval and be registered with Council. Vehicles are classified as a food vending vehicle or a food premises, depending on the following:

Mobile food vending vehicle

A food or coffee van, trailer or truck. This includes any registerable vehicle that can be used on land that can either be self driven or be towed on public roads and is used in connection with the sale of food.

Mobile food premises 

Carts, bicycles or similar movable means of transport, whether self propelled or not and is used in connection with the sale of food that is located other than where the mobile food premises is stored when not in use.
