Public Activities, Weddings, Funerals and other private ceremonies on Council owned or managed land

If you are planning to have any of the following activities on land that is owned or managed by Byron Shire Council you will need to fill in an Application Form for a Temporary Licence:

  • A Public Activity (eg: sporting event, community event, public entertainment, fundraising event for a charitable organisation,  political gatherings etc)
  • A Wedding
  • A Private Ceremony (eg naming ceremony)
  • A Funeral
  • Commercial Stills Photography

Not all beaches or reserves in Byron Shire are under the care and/or management of Byron Shire Council. 

  • Wategos, The Pass and the Lighthouse are under the care of Cape Byron Trust.  To request permission to use any of these sites you can contact Cape Byron Trust on 02 6620 9300 or npws.byroncoast@environment.nsw.gov.au
  • Belongil Beach, north of Kendall Street Byron Bay, and Broken Head Beach are managed by the Crown Lands Division of the NSW Department of Trade and Investment.  They can be contacted on 1300 886 235.
  • Torakina Park, Banner Park and The Terrace Park in Brunswick Heads are managed by North Coast Holiday Parks Trust.  They can be contacted on 02 6686 5171 or info@northcoastparks.com.au.

Application for a Temporary Licence to use Council owned or managed land

Please read the following information carefully. 

  • Be aware that you may be required to obtain other approvals from Council, apart from your temporary licence, which may take extra time and incur additional costs.
  • Please answer all the questions on the application form, and attach any additional information requested.  Not answering all the questions, or providing sufficient detail can result in delays in processing your application.
  • For wedding or private functions – you must fill out the casual hirer’s checklist, and pay the licence and application fee.
  • Weddings on Council owned or managed land are limited to 2 hours and 150 people.
  • For public activities – you must provide evidence of public liability insurance (minimum $10 million AUD) and pay the licence and application fee.  (Fees may be waived if you qualify for the Non-Commercial Community Rate* - please see the fees and charges section below for more information).
  • All public activities applications must have the risk assessment at the end of the application filled out.
  • All applicants are required to contact the Duty Planner to check whether additional approvals, apart from the temporary licence, are required.   The Duty Planner can be contacted on  Ph:  02 6626 7025 or email dutyplanner@byron.nsw.gov.au

Lodging an application:

You can lodge your completed application and attachments in person at Council’s Administration Building, 70-90 Station Street Mullumbimby, via fax on 02 6684 3018, or via email to council@byron.nsw.gov.au.  Payment of the application fee must accompany your application.

For a Funeral:

The completed application form and all required attachments must be lodged with Council at least 3 days prior to the ceremony.

For a Wedding or other private ceremony:

The completed application form and all required attachments must be lodged with Council at least six weeks prior to the ceremony.

For a low impact public activity:

The completed application form and all required attachments must be lodged with Council at least 2 months prior to the event.

For a major public activity:

If the activity is major or involves any sort of road closure, the completed application form and all required attachments must be lodged with Council at least 6 months prior to the event.

Please note:  Council reserves the right to refuse an application that is lodged without sufficient notice.

If the application is approved, and full payment of the licence and application fee is made, the Applicant will be issued with a temporary licence.  This  must be signed by both the Applicant and Byron Shire Council.  Examples of Council’s temporary licences are available for viewing on Council’s website in the Publications menu.

Payment:

Options for payment include cash, cheque, credit card or money order.  Attached below is a credit card authorisation form should you wish to use this method of payment.

*Community Rate must meet the following guidelines:

  • Not for profit incorporated body raising money for a registered charity.  Letter of support from registered charity and certificate of incorporation to be provided; OR

  • Registered as an income tax exempt charity (ITEC) with the ATO, with evidence to be provided.

**Non-commercial means:

  • Any activity that does not generate income from the use of Council owned or managed land that is assessed as not meeting the definition of Community Rate.

***Commercial means:

  • Any activity that generates income from the use of Council owned or managed land that is assessed as not meeting the definition of Community Rate.
