Local Environmental Plan (LEP) Amendments

Byron Shire Council currently has a number of LEP amendments at various stages in the process. Please refer to the Department of Planning’s website for information on Councils current planning proposals:

Please be advised that until further notice planning proposals will not be accepted by Council.  On 23 August 2010 Council resolved (10-742) to not accept planning proposals after 30 September 2010 in order for staff resources to be directed to finalising the Shire-wide Local Environmental Plan.  This website will be updated when this situation changes.

Planning Proposals

On 1 July 2009, changes were made to the provisions contained in Part 3 of the Environmental Planning and Assessment Act 1979 relating to the preparation and making of Local Environmental Plans. These new changes affect the process in which amendments to the Byron Local Environmental Plan (LEP) 1988 and amendments to any subsequent LEP can be prepared.

Council adopted (10-617) a process to initiate a LEP amendment, see flowchart:

Also, refer to Department of Planning’s ‘Guide to preparing Local Environmental Plans' and
Guide to preparing planning proposals’.

Council’s fees and charges schedule applies to planning proposals.
