LEP Amendments

Byron Shire Council currently have a number of LEP amendments at various stages in the process.  There are only two draft amendments that have been publicly exhibited but have not been gazetted, including:

• Draft Byron LEP Amendment No 87 (Dwelling entitlement – RTA, Lot 53 & 55 in DP 881232 at Pacific Highway, Tyagarah) – draft LEP with DoP awaiting finalisation.
• Draft Byron LEP Amendment No 108 (Amendments to Clause 43).

On 1 July 2009, changes were made to the provisions contained in Part 3 of the Environmental Planning and Assessment Act 1979 relating to the preparation and making of Local Environmental Plans. These new changes affect the process in which amendments to the Byron Local Environmental Plan (LEP) 1988 and amendments to any subsequent LEP can be prepared.

Council staff are currently preparing an information package on the new process. These will be available on this website when they have been completed and adopted by Council. Please contact Council’s Community Planning section on (02) 6626 7126 if you have any questions regarding the new LEP preparation process or wish to submit a rezoning proposal.

It should be noted that there are interim provisions for existing rezoning applications currently being considered by Council.  These provisions also apply to the draft Shire-wide LEP which Council is currently preparing, which will continue to be processed under the provisions used for LEP preparation prior to 1 July 2009.
