Byron Shire Council is the consent authority for this Development Application for Designated Development and Integrated Development and the Joint Regional Planning Panel (Northern Region) has the function of determining the application. Should you make a submission in relation to this application it will be made available to the Joint Regional Planning Panel for their consideration and may be viewed by other interested parties

Upgrade and construction of new road in the Butler Street road reserve comprising extension of Butler & Browning Streets, partly in Shirley Street, Lawson Street, Somerset Street, Burns Street, Wentworth Street and Jonson Street. New level rail crossing. Three new roundabouts and upgrade Shirley, Lawson and Butler Street roundabouts. Two new culverts and upgrade of one existing culvert.


The abovementioned development application has been lodged with Byron Shire Council. The proposed development is designated development and integrated development. The development application and the documents accompanying the application including the Environmental Impact Statement are to be exhibited from 17 July 2015 to 17 August 2015 (submission period) and may be inspected at:

  • the Byron Shire Council offices, Station St, Mullumbimby between the hours of 9.00am and 4.00pm Monday to Friday (public holidays excluded), Byron Bay Library cnr Lawson & Middleton Sts Byron Bay (refer to Council’s website for opening hours) or on Council’s website, and

Any person during the abovementioned submission period may make written submissions to Council concerning the development application. If a submission is made by way of objection, the grounds of objection must be specified in the submission.

The integrated development approvals that are required and the relevant approval bodies for those approvals are:

  • A permit under Part 7 of the Fisheries Management Act 1994 from NSW Department of Primary Industries (Fishing and Aquaculture).
  • An approval under Section 57 of the Heritage Act 1977 from the Heritage Division of the NSW Office of Environment and Heritage.

Please quote the abovementioned development application number and parcel number when making a submission. The submission must be received by 4.00pm on the final day of the submission period.

Any person who makes a submission by way of objection and is dissatisfied with the determination of the consent authority to grant development consent may appeal to the NSWLand and Environment Court. However if the Planning Assessment Commission conducts a review, the Minister’s determination of the application is final and not subject to appeal.

If you are making a submission you may be required to lodge a “Political Donations and Gifts Disclosure Statement”. It is your responsibility to ensure you meet your obligations to disclose reportable political donations and gifts. A failure to meet your obligations is an offence.
