Trades and Services Register

Expression of interests for inclusion on Council’s Trades and Services Register.

Definition

A contractor is a person or entity that, as part of an independent business, becomes obligated to provide goods and/or services for a price.  A contractor is characterised by the presence of the following elements:

  • Contractors retain control over how the work they are hired to do gets done
  • The person or company paying the independent contractor controls only the outcome - the product or service
  • The contractor is a registered business or company for taxation purposes

    Required Documentation

    At a minimum, the following documentation must be submitted with your application:

    • WorkCover accredited certificate for satisfactory completion of the general course for “Occupational Health & Safety Induction Training for Construction Work” (known as ‘the green card’)
    • OH&S Manual or completed Workcover Subby Pack
    • Certificate of currency showing expiry date and indemnity limit for public liability insurance for not less than $10 million.  (The policy must note the interest of Byron Shire Council as a principal and contain provision for principal’s indemnity.)
    • Certificate of currency showing expiry date and indemnity limit for Workers Compensation Policy and/or personal accident insurance covering workers or self employed, working in NSW.
    • Certificate of currency showing expiry date and indemnity limit for motor vehicle insurance, where the service offered involves plant or vehicle hire.

    OH&S documentation as detailed in this application form must also be provided.

    Applications submitted without all of the required documentation will not comply and Council reserves the right to include or exclude non-complying applications from the register.

    Registration

    Contractors must fully complete the application form and provide all required documentation to qualify for registration.

    Council will register all complying applications. 

    Selection for engagement will be on the principal of best value for public money.  This does not automatically mean acceptance of the ‘lowest price’ but may include non-price factors such as quality, experience, delivery time and reliability.

    Inclusion on Council’s register does not guarantee work.  Nor does inclusion guarantee that you will be asked to provide quotes on all or any required works.

    Council reserves the right to engage contractors who are not included on the register.

    Council will update the register at least once every four months.  Applications received after the annual closing date will be included at this time.   Late applications will only be included once all essential documentation has been provided.

    Continued registration may be dependant upon performance reviews by council staff.

    Responsibilities of Contractors

    Specific responsibilities for anyone engaged by Council include but are not limited to:

    • compliance with all legislation, regulations, codes of practice, Australian standards and Council’s policies and procedures.
    • a commitment, capacity and intent to comply with OH&S Act (2000) and Regulation (2001).
    • identification and reporting of  Safety and Environmental Hazards in the Workplace.  A risk assessment is to be conducted for each work location and activity.  A ‘Risk Assessment Form’ is available upon request.
    • providing an approved statement declaring compliance with statutory obligations in the areas of  Worker’s Compensation, Remuneration and Payroll Tax.  A ‘Subcontractor’s Statement’ form is available upon request.

    All Hired Plant and Operators must comply with “Standard Conditions of Plant Hire” A.C.E.1985.
